These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you”, “your”, “subscriber”) and Such is Lyff Pty Ltd (ACN 701 483 954) trading as Lyff (“Lyff”, “we”, “us”, “our”) governing your access to and use of the Lyff platform, website, and all associated services (collectively, the “Platform”).
By creating an account, clicking “I agree,” or otherwise accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (available at lyff.com.au/privacy), which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Platform.
These Terms apply to all subscribers and account holders, Lyff Guardians and Custodians who accept invitations through the Platform, Future Message recipients to the extent they interact with the Platform, marketplace partners who are listed on the Platform, and visitors to lyff.com.au.
Not legal advice
Lyff is a technology platform, not a legal, financial, or estate planning adviser. Nothing in these Terms or on the Platform constitutes legal, financial, tax, or estate planning advice. If you require such advice, please consult a qualified professional. Storing a document on the Lyff Platform does not make it legally valid, for example, storing a will does not execute it.
To create an account and use the Platform you must:
Be 18 years of age or older
Be an Australian resident or have a legitimate need to use an Australian-hosted digital vault service
Have the legal capacity to enter into a binding contract
Provide accurate, current and complete registration information
By creating an account, you represent and warrant that you meet these eligibility requirements. You are responsible for keeping your account information accurate and up to date.
One account per person. You may not create multiple accounts or transfer your account to another person. You are responsible for all activity conducted through your account. You must notify us immediately if you become aware of any unauthorised use of your account.
We reserve the right to verify your identity at any time and to suspend or terminate accounts where we have reason to believe the eligibility requirements are not met.
3.1 Core features
The Lyff Platform is a secure digital life vault that provides the following core features, subject to the plan you have subscribed to:
My Vault: encrypted storage for personal documents, financial records, legal documents, medical information, wishes, and account details, organised by category
Lyff Guardians: the ability to nominate trusted contacts with access to a designated Guardian folder within your vault
Lyff Custodians: the ability to nominate professional contacts (financial planners, legal firms, estate administrators) with access to designated vault sections for professional purposes
Future Messages: the ability to create written or video messages scheduled for delivery to nominated recipients on a specified date or trigger condition
Inactivity Safeguard: a welfare check system that monitors account activity and initiates a contact and verification sequence in the event of prolonged inactivity
Partner Marketplace: a directory of professional service providers
Activity log: a record of account activity accessible to you at all times
3.2 Feature availability by plan
Features available to you depend on your subscription plan. Full details of features by plan are available at lyff.com.au/plans. We may update feature availability from time to time in accordance with clause 5.5.
3.3 Nature of the Guardian and Custodian access roles
The Lyff Guardian and Custodian roles are features of the Platform that allow subscribers to designate trusted contacts and professional advisers with access to specified vault content. Lyff does not independently verify the identity, credentials, or suitability of persons nominated as Guardians or Custodians, that is the subscriber’s responsibility. Lyff’s role is to give effect to the subscriber’s access nominations through the Platform’s technical controls. The Guardian relationship exists between the subscriber and the Guardian; Lyff facilitates it but is not a party to it. Any dispute between a subscriber and a Guardian or Custodian is a matter between those parties.
3.4 Nature of Future Messages
Future Messages are created by subscribers and stored encrypted on the Platform until the delivery condition is met. Lyff acts solely as a conduit for delivery in accordance with the subscriber’s instructions. Lyff does not review, edit, censor or approve the content of Future Messages. The subscriber is solely responsible for the content of Future Messages, including ensuring that the content is lawful and appropriate for the recipient. Lyff is not liable for the emotional, psychological or other impact of Future Messages on recipients. Video messages are delivered by secure link and recipients can access them for 90 days from delivery. Lyff does not archive, preserve or guarantee access to video messages after the 90-day period.
When you register, you must provide your legal name (or preferred name), email address, and a password. You must also complete two-factor authentication setup before accessing the vault.
You are responsible for:
Maintaining the confidentiality of your password, two-factor authentication credentials and Recovery Key
All activity that occurs under your account
Notifying us immediately of any suspected unauthorised access to your account
Ensuring your email address remains active and accessible, as it is used for account recovery, Inactivity Safeguard communications, and security alerts
We will never ask you for your password, your Recovery Key, or your two-factor authentication codes in an email or phone call. Any communication requesting these should be treated as fraudulent and reported to us immediately.
Recovery Key
When you set up your vault, Lyff generates a Recovery Key, a unique code that provides a secondary means of account recovery. Your Recovery Key is the only self-service mechanism for recovering your account if you lose access to your email and two-factor authentication credentials. We strongly encourage you to download and store your Recovery Key securely (for example, as a printed copy with your important documents). Lyff does not store your Recovery Key in a form that allows us to provide it to you. If you lose both your Recovery Key and your standard recovery options, your account recovery will require identity verification by Lyff’s support team, which involves a waiting period and documentation requirements.
5.1 Subscription plans

The Long Term 5 Year Plan is a single, one-off upfront payment covering five years of access to the relevant plan, with no recurring charges during that period. Current pricing is displayed at lyff.com.au/plans at the time of subscription. Pricing displayed at the time you subscribe is the pricing that applies to your subscription until changed in accordance with clause 5.5.
5.2 Billing and payment
Monthly subscriptions are billed on the same date each month. Annual subscriptions are billed annually on the subscription anniversary date. The Long Term 5 Year Plan is a single one-off payment and does not renew automatically. All prices are in Australian Dollars.
Payment is processed by Stripe. By subscribing, you authorise Lyff to instruct Stripe to debit your nominated payment method for the applicable fees. You must ensure your payment details are accurate and your payment method has sufficient funds. If a payment fails, we will notify you and attempt to retry. We may suspend your access to paid features if payment remains outstanding after reasonable notice.
5.3 Free plan
The Free plan is available without payment for 12 months from the date you create your account. If you cancel a paid subscription, the Standard Cancellation, Retrieval and Deletion Process in clause 16.1 applies instead, and you do not move to the Free plan. Features available on the Free plan are set out at lyff.com.au/plans. We reserve the right to modify the features available on the Free plan with 30 days’ notice.
Free plan period ending
If you have not upgraded to a paid plan by the end of your 12-month Free plan period, your vault moves to a read-only state: you can view and export your Vault Contents, but you cannot add or edit documents. We will send you reminder emails during this period encouraging you to upgrade or export.
You will then have 90 days from the date your vault moves to read-only to upgrade to a paid plan or export your Vault Contents. We will send further reminders during this 90-day window. If you take no action within that period, your account will revert permanently to the standard Free plan limits (currently 5 documents, 5MB per file), and any Vault Contents beyond those limits will be permanently and irreversibly deleted. This deletion is described further in clause 18.
If you upgrade to a paid plan at any point during either period, your vault is restored to full read/write access immediately and nothing is deleted.
5.4 Refunds
Our approach to refunds and cancellations, and your rights under the Australian Consumer Law, are set out in full in our Refund & Cancellation Policy (available at lyff.com.au/refunds), which forms part of these Terms.
Nothing in that policy, or in these Terms, excludes, restricts or modifies any right or remedy, or any guarantee, warranty or condition, implied or imposed by the Australian Consumer Law, where it would be unlawful to do so. Where the ACL requires us to provide a refund or remedy, we will do so.
5.5 Price changes
We may change subscription pricing from time to time. We will give you at least 30 days’ notice of any price increase before it takes effect. If you do not wish to pay the new price, you may cancel your subscription before the new price takes effect and you will not be charged the new price. Your continued use of the Platform after a price change takes effect constitutes your acceptance of the new price.
5.6 GST
All prices are shown in Australian Dollars and are inclusive of GST. A tax invoice, including our ABN, is available for each payment on request.
5.7 Lyff First 50 offer
Subscribers who join as part of Lyff First 50 (the first 50 sign-ups) receive 50% off their first year on the Complete Annual or Family Annual plan. The discount is applied automatically at checkout and does not require a promotional code.
The Lyff First 50 discount applies only to the first 12 months of the subscription. From the start of the second year, the then-current standard annual price applies. The offer is limited to the first 50 sign-ups on annual Complete or Family plans and is not available on monthly billing, the Long Term 5 Year Plan, or in combination with any other offer.
You retain ownership of all documents, data, content and information you store in your vault (“Vault Contents”). By storing Vault Contents on the Platform, you grant Lyff a limited, non-exclusive, revocable licence to store, encrypt, and process your Vault Contents solely for the purpose of providing the Platform services to you.
Lyff does not claim any ownership of or rights in your Vault Contents beyond this licence. We will not use your Vault Contents for any purpose other than providing the Platform services to you, including not using Vault Contents for training machine learning or artificial intelligence models.
You are responsible for ensuring that:
You have the right to store the content you upload to the Platform
Your Vault Contents do not include content that is unlawful, infringes third-party intellectual property rights, or is otherwise prohibited under these Terms
Personal information you store about third parties is handled in accordance with applicable privacy law
Lyff does not verify, review or endorse the accuracy or completeness of Vault Contents. Storing a document on the Platform does not make it legally valid or binding.
7.1 Nominating a Guardian
You may nominate one or more individuals as Lyff Guardians. A Guardian must accept their invitation through the Platform before the Guardian relationship takes effect. By nominating a Guardian, you authorise Lyff to send the Guardian an invitation email and, on acceptance, to provide the Guardian with access to the Guardian folder you have created for them. You are responsible for ensuring that the person you nominate consents to being nominated and to the sharing of their contact details with Lyff. You may remove a Guardian at any time through the Platform’s settings.
7.2 Guardian access during the subscriber’s lifetime
Guardians can see the contents of the Guardian folder from the time they accept their invitation, subject to the access settings you have applied. They cannot see any other part of your vault unless you explicitly share additional content with them. Guardian access during your lifetime is entirely within your control. You may add or remove content from the Guardian folder at any time.
7.3 Guardian access following death or incapacity
Following completion of the verification process set out in the Lyff Inactivity Safeguard and Account Lifecycle Policy, and subject to all verification requirements being met, the Guardian’s access to the Guardian folder is formally confirmed. The Guardian does not receive access to the broader vault. Lyff’s obligation is to make the Guardian folder accessible in accordance with your prior instructions and the verified circumstances. Lyff is not responsible for ensuring that the Guardian takes any particular action following handover.
7.4 Lyff Custodians
You may nominate professional advisers (such as financial planners, legal firms or estate administrators) as Lyff Custodians. Custodians receive access to the specific vault sections you designate for professional access. Custodian access during your lifetime is at your discretion and subject to the access settings you have applied. Custodian access following your death or incapacity requires completion of the Lyff Release Process set out in the Lyff Inactivity Safeguard and Account Lifecycle Policy. The Lyff Release Process requires verification documentation, such as a death certificate or a medical certificate of incapacity, photo identification, and a statutory declaration, but does not require a Grant of Probate or Letters of Administration. Lyff does not make an independent judgement call on the circumstances; verification follows the standard set out in that Policy. Guardian and Custodian items release at the same moment once verification is complete, and the other nominated party is notified automatically. Lyff does not verify the professional credentials of Custodians at the time of nomination, that is your responsibility.
8.1 How the Inactivity Safeguard works
The Inactivity Safeguard is a welfare check and notification system. At intervals you choose (3, 6 or 12 months, defaulting to 6 months), Lyff sends you a check-in email. If you do not respond, Lyff will send further contact attempts by email and SMS over a period of up to two weeks. If we cannot reach you, Lyff will initiate a Guardian welfare check, followed if necessary by a Custodian advisory notification. If no party can confirm you are well, a verification process opens. The full process, timelines and requirements are set out in the Lyff Inactivity Safeguard and Account Lifecycle Policy, which forms part of these Terms. 8.2 Your obligations regarding the Inactivity Safeguard
You are responsible for: keeping your registered email address and phone number current; responding to check-in communications; pausing the Safeguard when you anticipate being unavailable for an extended period (such as international travel); and ensuring your Guardian and Emergency Contact details are current. Lyff is not liable for consequences resulting from your failure to respond to check-in communications where those consequences result from our reasonable good-faith operation of the Safeguard in accordance with these Terms.
8.3 Lyff’s obligations and limitations
Lyff will operate the Inactivity Safeguard in good faith and in accordance with the process described in the Lyff Inactivity Safeguard and Account Lifecycle Policy. However: (a) the Inactivity Safeguard is a technology-based system and is subject to the inherent limitations of any such system, including the possibility of technical failures; (b) Lyff does not guarantee that the Safeguard will correctly identify all cases of death or incapacity, or that it will not incorrectly advance in edge cases; (c) the Safeguard is not a substitute for a legally valid will, power of attorney or advance care directive; and (d) Lyff’s verification requirements are designed to protect subscribers from fraudulent or mistaken death notifications, but Lyff cannot guarantee that the verification process will prevent all fraudulent claims.
8.4 Automated decision-making disclosure
The advancement of the Inactivity Safeguard contact sequence is automated, it advances based on the absence of a response, not a human decision in each case. However, no vault content is released and no Future Messages are delivered based solely on the automated trigger. Human verification by Lyff staff is required before any release occurs. Subscribers can halt the sequence at any point by logging in. This disclosure is made in connection with transparency requirements for substantially automated decisions under the Privacy and Other Legislation Amendment Act 2024 (Cth), which apply from 10 December 2026.
9.1 Date-scheduled Future Messages
Future Messages you schedule for a specific date are delivered on that date, subject to the recipient’s email address remaining valid and deliverable. Lyff will make reasonable attempts to deliver a scheduled Future Message but does not guarantee delivery if the recipient’s email address is invalid, blocked, or otherwise undeliverable. Lyff is not responsible for the recipient’s failure to receive a message due to their own email settings, spam filters, or service provider restrictions.
9.2 Inactivity-triggered Future Messages
Future Messages you set to deliver if something happened to you are held encrypted until the verification process is complete. Following verification, they are queued for delivery and released within 14 days, subject to the 14-day post-verification window described in the Lyff Inactivity Safeguard and Account Lifecycle Policy. You acknowledge that delivery of inactivity-triggered Future Messages may be delayed beyond 14 days in exceptional circumstances, such as a legal dispute about the validity of the verification.
9.3 Content responsibility
You are solely responsible for the content of Future Messages. You must not create Future Messages that: are unlawful, defamatory, harassing, or threatening; infringe the intellectual property rights of any person; contain false statements that could harm the reputation of another person; or are otherwise inappropriate for the intended recipient. Lyff reserves the right to refuse to deliver a Future Message if we become aware that its content breaches these requirements, though we are under no obligation to review message content. Lyff will not be liable for any legal claim brought against the subscriber or their estate arising from the content of a Future Message.
9.4 Video messages
Video Future Messages are delivered as a secure link accessible for 90 days from delivery. After 90 days, the video link expires and Lyff will delete the video from its servers in accordance with the account lifecycle policy. If a recipient wishes to retain a video message, they must download or save it within the 90-day access window. Lyff accepts no responsibility for video messages that are not saved by the recipient within the access period.
10.1 Nature of the marketplace
The Lyff partner marketplace is a directory of professional service providers who have paid a listing fee to appear on the Platform. Listing in the marketplace does not constitute an endorsement by Lyff of any partner, their services, qualifications, suitability, or pricing. Lyff does not verify the credentials, qualifications, regulatory compliance, or suitability of marketplace partners beyond their agreement to our partner terms. You are responsible for conducting your own due diligence before engaging any marketplace partner.
10.2 Referral arrangements
Lyff may receive a listing fee from marketplace partners for their inclusion in the Partner Marketplace. These commercial arrangements do not influence the content of your vault or your obligations under these Terms. Lyff does not act as an agent for any marketplace partner.
Lyff is not a party to any contract between you and a marketplace partner. Any dispute with a marketplace partner is a matter between you and that partner. Lyff’s liability in connection with marketplace partners is limited as set out in clause 17.
You may use the Platform only for lawful purposes and in accordance with these Terms. You must not use the Platform:
In any way that breaches any applicable law or regulation, including Australian law
To store, transmit or publish unlawful content, including content that is defamatory, harassing, discriminatory, or that infringes any third party’s intellectual property rights
To impersonate any person or entity or misrepresent your identity or affiliation
To attempt to gain unauthorised access to any part of the Platform or another user’s account
To upload or transmit viruses, malware or any other malicious code
To use the Platform for any commercial purpose other than as expressly permitted by these Terms (including for resale or redistribution)
To attempt to reverse engineer, decompile or disassemble any part of the Platform
To use automated tools, bots or scrapers to access or collect information from the Platform
To interfere with the proper operation of the Platform
We reserve the right to suspend or terminate your account immediately if you breach this clause, without prejudice to any other rights or remedies available to us.
All intellectual property rights in the Platform, including the software, design, trademarks, service marks, logos, and all content created by Lyff, are owned by or licensed to Lyff. Nothing in these Terms grants you any right, title or interest in the Platform’s intellectual property.
The licence we grant you under clause 6 is a limited, non-exclusive, non-transferable, revocable right to access and use the Platform for your personal, non-commercial purposes, for the duration of your subscription.
You retain all intellectual property rights in your Vault Contents. By uploading Vault Contents to the Platform, you grant Lyff the limited licence described in clause 6, solely for the purpose of providing the Platform services to you.
Your privacy is important to us. Our Privacy Policy (available at lyff.com.au/privacy) explains how we collect, hold, use and disclose personal information in connection with the Platform. The Privacy Policy is incorporated into these Terms by reference and forms part of the agreement between you and Lyff.
By using the Platform, you consent to our collection, use and disclosure of personal information in accordance with the Privacy Policy. If you do not consent to the Privacy Policy, you must not use the Platform.
Lyff implements reasonable technical and organisational security measures to protect the Platform and Vault Contents, including AES-256 encryption at rest, TLS 1.3 in transit, multi-factor authentication, and infrastructure controls described in the Privacy Policy.
Despite these measures, no system is completely secure. Lyff does not warrant that the Platform is free from vulnerabilities, breaches or interruptions. You acknowledge and accept the inherent security risks associated with storing information online.
In the event of an eligible data breach, Lyff will comply with its obligations under the Notifiable Data Breaches scheme and our Privacy Policy.
You are responsible for the security of your own devices, credentials and network connection. You should ensure your devices are protected by up-to-date security software and that you use strong, unique credentials for your Lyff account.
Lyff will use reasonable endeavours to make the Platform available at all times, but does not guarantee uninterrupted or error-free access. The Platform may be unavailable due to scheduled maintenance (for which we will provide advance notice where reasonably practicable), emergency maintenance, third-party infrastructure issues, or events outside our control.
We will use reasonable endeavours to restore the Platform as soon as practicable following any unplanned outage.
Access to the Platform requires a compatible device, browser, and internet connection. We are not responsible for any failure to access the Platform resulting from your hardware, software, or internet service provider.
16.1 Termination by you
Standard Cancellation, Retrieval and Deletion Process
You may cancel your subscription at any time through Settings > Account & closure.
The following process applies to all paid plans, including monthly, annual and Long Term 5 Year Plans.
When you cancel, your paid access continues until the end of your current paid subscription period. Cancellation does not entitle you to a refund for the unused part of that period, except where required by the Australian Consumer Law.
When your paid access ends:
your subscription will not renew;
your vault will enter read-only mode for 90 days;
you may view and export your vault contents during that period, but you cannot add, edit or replace content;
Lyff will notify you of the scheduled deletion date and send reminders before that date; and
at the end of the 90-day period, your vault contents will be permanently and irreversibly deleted unless an approved extension or preservation hold applies.
You may request one extension of the read-only period for up to six months. The request must be made before the scheduled deletion date through Lyff Support or by emailing hello@lyff.com.au and must explain why additional time is required.
Lyff will consider extension requests reasonably and consistently, including where illness, incapacity, bereavement, technical difficulty, an authority dispute, probate, estate administration or another genuine barrier has prevented timely retrieval.
Submitting a timely and genuine extension request will temporarily pause deletion while Lyff assesses the request. An extension preserves the vault in read-only mode but does not restore paid features or establish any person’s authority to access or receive its contents.
Lyff may retain vault contents beyond the stated period where reasonably required by law, a court or regulatory direction, fraud or security investigation, unresolved dispute, or another valid preservation obligation.
Lyff will permanently delete the vault when the 90-day period or approved extension ends, unless a preservation hold remains in effect.
Closing your account
You may close your account permanently through Settings > Account & closure. On permanent closure, your Vault Contents will be deleted in accordance with clause 18. We will email you a reminder to export your vault, and you will have 30 days to do so before deletion proceeds.
16.2 Termination by Lyff
Lyff may suspend or terminate your account immediately, with or without notice, if:
You have materially breached these Terms and (where the breach is capable of remedy) have failed to remedy the breach within 7 days of written notice from us
You have breached the acceptable use policy in clause 11
You have provided false, misleading or incomplete information in connection with your account or the verification process
Your account is involved in any fraudulent, illegal or abusive activity
We are required to do so by law or a court order
Lyff may also suspend your account temporarily (without termination) for investigation of suspected breaches, security concerns, or non-payment. We will use reasonable endeavours to notify you of any suspension and its reason, except where doing so would compromise a security investigation.
16.3 Effect of termination
On termination of your account (whether by you or by us):
Your licence to use the Platform ceases immediately
Your Vault Contents will be deleted as described in clause 18
Any pending Future Messages that have not yet been delivered will be cancelled, unless their scheduled delivery date has already occurred
Your Guardians and Custodians will lose their access
Outstanding fees will remain due and payable
16.4 Termination following death or incapacity
The Inactivity Safeguard does not terminate the subscriber’s account immediately following notification of death or incapacity. The account remains active for the purposes of Guardian and Custodian access for a period of 12 months following the verified trigger event, after which the account and Vault Contents are permanently deleted in accordance with the Lyff Inactivity Safeguard and Account Lifecycle Policy. The timelines and notices applicable to this process are described in that Policy.
17.1 Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or condition, implied or imposed by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) where it would be unlawful to do so.
If you are a consumer under the ACL, you have the right to a remedy for major failures of our services. For failures that are not major, we are entitled to choose between providing a repair, replacement or refund. We do not exclude the consumer guarantees that apply under the ACL.
17.2 Limitation of liability
Subject to clause 17.1 and to the maximum extent permitted by law:
Our total liability to you for any claim arising from or in connection with these Terms or the Platform (whether in contract, tort including negligence, statute, or otherwise) is limited to the total subscription fees paid by you to Lyff in the 12 months preceding the event giving rise to the claim (or, for a Long Term 5 Year Plan subscriber, the amount paid for that plan)
We are not liable for any indirect, consequential, special, incidental or punitive loss or damage, including loss of data, loss of profits, loss of revenue, loss of opportunity, loss of goodwill, or damage to reputation, whether or not we were advised of the possibility of such loss
We are not liable for any loss or damage arising from: your failure to maintain adequate backups of your Vault Contents; your failure to keep your login credentials secure; the acts or omissions of Guardians, Custodians, Emergency Contacts or Future Message recipients; the failure of a third-party service provider including Stripe, AWS or our SMS provider; or Force Majeure events
17.3 Limitations specific to Lyff’s unique features
Without limiting clause 17.2, Lyff’s liability is specifically excluded or limited in the following circumstances: (a) Inactivity Safeguard, Lyff is not liable for any consequences arising from the correct operation of the Inactivity Safeguard in accordance with these Terms, including the release of Guardian access or Future Messages following a verified notification. Lyff is not liable for the failure of the Inactivity Safeguard to identify death or incapacity where the subscriber has not configured it, has disabled it, or has failed to maintain current contact information. (b) Future Messages, Lyff is not liable for the emotional, psychological or legal consequences of receiving a Future Message. Lyff is not liable for failed delivery due to invalid recipient email addresses. (c) Guardian and Custodian access, Lyff is not liable for any misuse of vault access by a Guardian or Custodian acting contrary to the subscriber’s instructions or the terms of their role. (d) Marketplace, Lyff is not liable for the acts, omissions, negligence, or breach of contract of any marketplace partner.
You may export your Vault Contents at any time through Settings > My data & export. We provide three export formats: a full vault ZIP archive, a human-readable PDF summary, and a CSV of your activity history. We encourage you to export your vault regularly and before closing your account or cancelling your subscription. Following cancellation of a paid plan, your vault is retained in read-only mode and then deleted in accordance with the Standard Cancellation, Retrieval and Deletion Process in clause 16.1.
On account closure, we will email you a reminder to export anything you would like to keep. You will have 30 days from that email to do so, after which your Vault Contents are permanently and irreversibly deleted. This deletion is not reversible. We will not retain copies of your Vault Contents following account closure, except for activity logs retained in de-identified form for 7 years as required by law.
We do not guarantee the ability to restore Vault Contents following accidental deletion by you through the Platform’s features. We maintain backups for the purposes of platform recovery, not individual file restoration.
Free plan document removal
If your account reaches the end of the 90-day period described in clause 5.3 without upgrading to a paid plan or exporting your Vault Contents, any Vault Contents exceeding the standard Free plan limits (currently 5 documents, 5MB per file) will be permanently and irreversibly deleted. We encourage you to export your vault before this occurs, using the export tools in Settings > My data & export. This deletion is not reversible.
The Platform relies on third-party service providers for certain functions, including Stripe (payment processing), Amazon Web Services (infrastructure and storage), Twilio (SMS notifications) and HubSpot (email and marketing communications). Your use of these third-party services is subject to those providers’ own terms and privacy policies.
The Platform may contain links to third-party websites, including marketplace partner websites. Lyff does not control and is not responsible for the content, privacy practices or terms of any third-party website. The inclusion of a link on the Platform does not constitute an endorsement by Lyff.
We are not liable for any loss or damage resulting from your access to or use of any third-party service or website.
Lyff will not be liable for any delay or failure to perform its obligations under these Terms to the extent that the delay or failure is caused by a force majeure event, that is, any event beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, civil unrest, government action, power failure, telecommunications failure, cyberattack or DDoS attack, or failure of a third-party service provider.
If a force majeure event prevents Lyff from providing the Platform services for more than 30 consecutive days, you may terminate your subscription and we will provide a pro-rata refund of any prepaid subscription fees for the period of unavailability.
Lyff may amend these Terms from time to time. We will give you at least 30 days’ notice of any material change by email to your registered address and by posting a notice on the Platform. Your continued use of the Platform after the effective date of an amendment constitutes acceptance of the amended Terms.
If you do not accept a material change, you may cancel your subscription before the change takes effect and receive a pro-rata refund of prepaid fees for the period after the change date.
We may also modify, add or remove Platform features from time to time. We will provide reasonable notice of material changes to core features. Modifications to the Platform that do not materially reduce the functionality of your plan do not entitle you to a refund.
If you have a dispute with us, please contact us first at hello@lyff.com.au. We will acknowledge your complaint within 5 business days and will endeavour to resolve it within 30 days. For complex complaints, we will keep you informed of progress.
If we cannot resolve a dispute through our internal process, either party may refer the dispute to mediation before a mutually agreed mediator. We agree to participate in mediation in good faith before commencing any court proceedings, unless urgent relief is required.
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria for resolution of any dispute that cannot be resolved through mediation.
Notices to you will be sent to your registered email address and are taken to be received 24 hours after sending (or 72 hours if sent on a non-business day). You are responsible for ensuring your email address is current and accessible. Notices to Lyff must be sent to hello@lyff.com.au or by post to PO Box 189, Elwood, VIC 3184, Australia.
